Terms and Conditions:
These Terms and Conditions ("Agreement") govern the provision of handyman services by Handy Dan MT LLC ("Contractor," "We," "Us," or "Our") to the customer ("Customer," "You," or "Your"). By contracting for services with Us, you agree to be bound by these terms. We provide a range of handyman, home and yard maintenance services, including but not limited to the above-mentioned services, as agreed upon by you the Customer with us the Contractor. By hiring Handy Dan MT LLC, you agree that you consent and agree that you believe us capable and competent to complete the said work.
Scope: We engage in cleaning, repair, assembly, and home/landscape maintenance only. Handy Dan MT LLC is an independent contractor and is not licensed as a construction contractor. We do not build, renovate, or make addition/subtraction to any part of a home structure.
Permits: Handy Dan MT LLC does not engage in any work that requires a construction permit. Customers are responsible for the application and approval of all permits and assume and accept all liability including fines and penalties for any failure to apply for or receive appropriate permitting. If you are unsure if your work requires a permit, you are encouraged to call the local permitting office. Handy Dan MT LLC assumes no liability for any permitting or lack of permitting, including HOA violations, or neighborhood covenants.
General Liability: We will use reasonable care and skill in performing the services. However, we are not liable for damage that occurs during the execution of the work unless it results directly from our negligence or failure to adhere to the agreed-upon scope of work. We are insured and carry all required insurances to engage in this work.
Indemnification: You agree to indemnify and hold harmless Handy Dan MT LLC from all claims, losses, or damages arising out of the work performed, except in cases of gross negligence or willful misconduct.
Property Damage: While we strive to protect your property, we are not liable for incidental or consequential damages, including but not limited to damage to property, personal injury, or loss of use of property resulting from or during our services, unless caused by Contractor's negligence.
Payment: Payment for services is due upon completion of the work, or within 10 days, unless otherwise agreed upon. Accepted forms of payment include cash, check, and Venmo. A deposit of 20% may be required for large projects. If you fail to make payment as agreed or cancel/dispute your payment, you may be subject to additional fees, including late payment charges of 20% of the total balance, and you will incur the cost for any collection or legal action including applicable interest. Returned checks are subject to a $30 fee, plus collection and legal fees.
Scheduling, Access and Cooperation: The Customer agrees to make available and provide to the Contractor, full access to the property to perform the requested services. Any obstructions or safety hazards that may prevent the Contractor from completing the work in a safe and timely manner must be addressed before work commences. The Customer must also ensure that the property is safe and free of hazards, and/or animals that could potentially cause harm to the Contractor. Failure will result in inability to complete scheduled work at no fault of Handy Dan MT LLC.
Pressure Washing: Customers are required to provide access to a clean water source (e.g., outdoor faucet or spigot) for the duration of the power washing service at their own cost. The water supply must provide sufficient pressure to support our equipment. If the pressure is low, please notify us in advance so we can adjust our approach. You must notify us If you are unable to provide water on-site prior to the scheduled service to discuss potential alternatives which will result in additional charges to cover the cost of providing water and transportation.
Electricity: Handy Dan MT LLC may require the use of electricity to complete certain tasks during your project. We may utilize your electricity for the duration of the work, and while we will make every effort to minimize energy consumption, you agree to cover any associated costs. If you have any concerns regarding electricity usage, please notify us before the work begins. If you choose not to allow us to utilize your electricity, or no electricity is available on site, additional fees may apply.
Compliance and Safety: The Contractor will comply with all relevant laws, regulations, and safety standards when performing the services. The Customer must notify the Contractor of any specific safety requirements or conditions at the property that must be addressed.
Dispute Resolution: In the event of a dispute, both parties agree to attempt to resolve the matter through informal negotiation. If the dispute cannot be resolved through negotiation, it will be submitted to mediation or court in Missoula Montana.
Governing Law: This Agreement is governed by the laws of Montana, without regard to its conflict of law principles.
Severability: If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remainder of the provisions will remain in full force and effect.
Entire Agreement: These Terms and Conditions, along with any separate written agreement or work order, constitute the entire agreement between the Customer and the Contractor.
